The court called the case a "heart-wrenching saga" and reaffirmed the right to live with dignity under Article 21.
The Bombay High Court has upheld a compensation of Rs 62 lakh awarded to the family of Charu Khandal, a 28-year-old animator with Shah Rukh Khan's Red Chillies Entertainment, who sustained critical injuries in a 2012 road accident and died nearly five years later, LiveLaw reported.
A division bench of Justices Girish Kulkarni and Advait Sethna dismissed an appeal filed by Cholamandalam MS General Insurance Co. Ltd., which had challenged the compensation awarded by the Motor Accidents Claims Tribunal (MACT), Mumbai, on November 27, 2020.
As per LiveLaw, the insurance firm argued that Khandal라이브 바카라 death in 2017 could not be directly attributed to the accident, as it occurred almost five years after the incident. However, the court rejected the contention, observing that the fatal injuries sustained in the March 25, 2012 accident led to a prolonged period of suffering and ultimately her death.
Calling the case “a tragic saga,” the court noted that Khandal, a young and promising professional working with actor Shah Rukh Khan라이브 바카라 production house, was at the peak of her career when the accident occurred. She was left paralysed due to severe cervical spinal cord injuries and spent months undergoing treatment at Kokilaben Dhirubhai Ambani Hospital. Her family spent over Rs 20 lakh on medical expenses, the court recorded.
"At the prime of her youth, she met with a fatal accident... She courageously faced the ordeal for about five years, and on 17 January 2017 she passed away," the bench observed according to the LiveLaw.
The judges emphasised that the Motor Vehicles Act is a “beneficial piece of legislation” designed to protect accident victims and their families. They further stated that courts must uphold the fundamental rights enshrined in Article 21 of the Constitution, including the right to live with dignity.
The judgment reaffirms the tribunal라이브 바카라 recognition of the direct link between the accident and Khandal라이브 바카라 eventual death and provides some measure of justice to her family after years of legal battle.
