Court expresses lack of faith in police, to monitor probe into hate speech case against Madhya Pradesh Minister.
In a scathing critique of Madhya Pradesh Police, the High Court on Wednesday slammed the force for its "casual" and poorly drafted FIR against Tribal Welfare Minister Kunwar Vijay Shah, over alleged hate speech targeting Colonel Sofiya Qureshi, the Hindu reported.
The FIR was filed following national outrage over Shah라이브 바카라 use of communal and gendered slurs during a public address in Mhow. The High Court had earlier taken suo motu cognizance of the incident and ordered that an FIR be filed by Wednesday evening.
A division bench comprising Justices Atul Sreedharan and Anuradha Shukla did not mince words while examining the content of the FIR. Justice Sreedharan remarked, “Have you read the FIR? How has it been drafted? There are no ingredients. It has been drafted in such a manner that it can be quashed... The allegations must come out.”
The court noted that the FIR failed to describe any specific offence beyond referencing a dated order, the Hindu reported. “There is no description of what the offence is… That is why we draw our inferences,” Justice Sreedharan added.
Citing the deficiencies, the bench further voiced its lack of confidence in the police라이브 바카라 ability to carry out a fair and impartial investigation. In a rare move, the court announced it would monitor the investigation.
“In view of the nature of the case and the manner in which the FIR has been registered, it does not inspire confidence of the Court that if the case is not monitored, the Police would investigate fairly, in the interest of justice and in accordance with law,” the order stated.
This judicial intervention comes on the heels of the Supreme Court rejecting Shah라이브 바카라 plea for interim relief from criminal proceedings. The apex court instead directed the minister to "go and apologise in the High Court."
The High Court's decision to oversee the probe adds a new dimension to the controversy surrounding the minister, who continues to face mounting public and legal scrutiny.
