RG Kar Case: Calcutta HC Questions CBI Over Possibility Of Gang Rape, Parents Seek Fresh Investigation

The Calcutta High Court has questioned the Central Bureau of Investigation (CBI) over the possibility of a gang rape in the RG Kar Case of August 2024. As the state court heard a plea filed by the parents of the deceased doctor, Calcutta HC called on the central agency to submit its response.

In August 2024, the nation was shocked after the gruesome rape-murder of a 31-year-old resident doctor at Kolkata's RG Kar Medical College and Hospital.

In January 2025, a trial court sentenced accused Sanjay Roy to life imprisonment. However, the parents of the deceased doctor filed a fresh plea before the High Court demanded another investigation into the case.

Upon hearing the matter, Justice Tirthanker Ghosh called on the CBI to answer the following questions -

  1. Whether the language of the chargesheet indicated a single accused or a gang rape

  2. If CBI considered invoking Section 70 of the Bharatiya Nyaya Sanhita (BNS), which deals with gang rape.

"You must tell me if at any time you took into consideration for investigating under section 70 of BNS (gang rape)? Accused was convicted. What was the nature of your charge? Was it a sole accused or a gang rape? You must make it clear. Then I will ask for reports...Was the crime committed by the sole accused? What was the nature of charges? If you ever believed more than one person was involved, who were the people in your mind? You must tell the court. Was it gang rape or destruction of evidence where multiple people were involved? the Court asked the CBI, as per LiveLaw.

The matter has now been listed for hearing on March 28th, 2025.
