The Rouse Avenue Court has ordered the Delhi Police to file an FIR against BJP leader Kapil Mishra. The court directive comes after it stated it found "cognizable offence" against Mishra and his involvement in the 2020 Delhi Riots.
The court has also ordered further investigation against the Delhi Law Minister due his role in inciting the violence in North East Delhi in 2020.
" The court said that on the basis of material placed by Delhi Police his presence was in the area of Kardam Puri and a Cognizable offence has been found that needs to be investigated," reported news agency ANI.
This development comes as the court was hearing a plea which challenged the Delhi Police's report stating that Mishra was being framed as part of a larger conspiracy.
Delhi Police further stated that the BJP leader was being framed in the matter and had no role to play in the 2020 riots.
However, the court observed that the material shared by the prosecutors reveal that Mishra was present in the area in question in 2020.
In the 2020 Delhi Riots case, Delhi police has named several student leaders such as Umar Khalid, Gulfisha Fatima and Sharjeel Imam as co-conspirators of the riots.
However, as per the findings of a 10-member fact-finding team, the Delhi violence and riots "Were planned and targeted," and held Kapil Mishra responsible for the incident.
As per the report issued by the Delhi minorities commission, "violence started in different pockets almost immediately after the short speech of Shri Kapil Mishra on 23 February, 2020 at Maujpur in which he openly called for forcefully removing the protestors at Jafrabad in North East Delhi.”
