Indian national Kulbhushan Jadhav, who is imprisoned in Pakistan over allegations of being an Indian spy agent, did not get a chance to appeal to a higher court even after the 2019 International Court of Justice (ICJ) verdict that allowed him consular access, Pakistani newspaper Dawn reported.
ICJ ruled in India라이브 바카라 favour in 2019, allowing Jadhav consular access. However, this verdict did not translate into an appeal, Defence Ministry lawyer Khawaja Haris Ahmed informed the constitution bench of the Supreme Court on Thursday.
ICJ라이브 바카라 verdict said, "Court finds that Pakistan deprived India of the right to communicate with and have access to Kulbhushan Jadhav, to visit him in detention and to arrange for his legal representation and thereby breached obligations incumbent upon it under Vienna Convention on Consular Relations,” India Today reported.
The Supreme Court had asked why other Pakistani citizens were not provided the right to appeal in regard to the May 9, 2023 riots after the arrest of Pakistan Tehreek-e-Insaf leader and former Prime Minister Imran Khan when Jadhav was. The Defence Minister informed that even Jadhav did not get to appeal since the verdict only mentioned consular access.
Who is Kulbhushan Jadhav?
Jadhav - a former Indian Navy officer - was abducted and taken to Pakistan when running a business in Iran. He was allegedly arrested in March 2016 in Balochistan, near the Pakistan-Afghanistan border, Mint reported.
He was sentenced to death in April 2017 after Pakistan라이브 바카라 claim that Jadhav admitted to be working for the Indian intelligence agency - Research and Analysis Wing (RAW). Pakistan released a video of Jadhav 'confessing' to be a RAW agent.
His execution was suspended after ICJ ruled in India라이브 바카라 favour, since then only one consular access has been provided to Jadhav, according to Mint.
Pakistan라이브 바카라 SC was told that the country라이브 바카라 laws were not in line with the Article 36 of Vienna Convention before the ICJ ruling - which protects the rights of foreigners arrested or detained in the host country and allows them consular access, visit and communication. The country라이브 바카라 laws were amended after the 2019 verdict.
