The Supreme Court of India rapped the Allahabad High Court for another recent controversial remark made during a rape case hearing. The top court hauled up the High Court for its comment that the rape survivor "invited trouble" for herself.
This incident comes after the Allahabad High Court was slammed for stating that grabbing a girl's breats and breaking the string of her pyjamas is not an attempt to rape by aggravated sexual assault.
While hearing the recent rape case, the Supreme Court bench of Justice Justices BR Gavai and AG Masih criticised the horrific remark made by the court and asked judges to be careful.
"There is another order now by another judge. Yes, bail can be granted... but, what is this discussion that she herself invited trouble? One has to be careful when saying such things, especially on this side (judges). One thing here and there...," said the bench.
In a case dating back to 2024, the Allahabad High Court granted bail to a person accuped of raping a postgraduate student. While hearing the matter, the High Court ruled that the student "was inviting trouble" and was responsible for the rape.
The accused, who was arrested in December 2024, has alleged that the act was consensual.
"This court is of the view that even if the allegation of the victim is accepted as true, then it can also be concluded that she herself invited trouble and was also responsible for the same," Justice Sanjay Kumar Singh said.
